The “Name an Inspiring Woman!” contest (the “Contest“) is organized by Groupe Touchette inc. (the “Organizer“), whose principal place of business is at 750, Lebeau Blvd., Montreal (Quebec) H4N 1S4. The purpose of the Contest is to celebrate women who embody the values of strength, resilience and support. It will be conducted on the Internet only.
ELIGIBILITY
The Contest is open to Canadian residents who have reached the age of majority in their province or territory of residence, with the exception of residents of the Yukon, Northwest Territories and Nunavut. The participant’s place of residence determines the territory in which he or she is eligible.
Employees, representatives, and agents of the Organizer, its affiliates, distributors, advertising or promotional agencies, as well as immediate family members or individuals living in the same household, are not eligible to participate.
No purchase is required to enter the Contest.
HOW TO PARTICIPATE
To participate:
The person submitting the video (the “Submitter“) as well as the woman nominated in the video (the “Nominee“) must have a valid Instagram account (an “Account“). If one or both persons does not have an Account, they must visit www.instagram.com or download the application, and register in accordance with the enrollment instructions for a free Instagram account.
The Submitter must follow Groupe Touchette’s official Instagram page: @groupe_touchette.
During the Contest period, the Submitter must send, in a private message to the Instagram account @groupe_touchette, a video no longer than one (1) minute highlighting a woman who exemplifies the following values:
Inner Strength: The ability to face challenges with courage.
Resilience: Exemplary perseverance in the face of adversity.
Community Support: A lasting and positive impact on those around her.
The Submitter must ensure that the Nominee has given consent for her personal details, name, image and story to be used in connection with the Contest. Any complaint by the Nominee will result in the removal of the video and the cancellation of the entry.
The Submitter must identify («tag») the Nominee in a comment under the official Contest publication available on the Instagram account @groupe_touchette.
The Nominee must then like the official Contest publication under which she is identified in a comment, as well as follow the Instagram account @groupe_touchette. These two actions constitute the Nominee’s and Submitter’s consent and agreement to be legally bound to the Contest rules and validate the Nominee’s participation in the Contest.
Participation in the Contest implies immediate acceptance of the Official Contest Rules.
Provided that the above conditions are met, only the Nominee is considered to be participating in the Contest and has a chance of being declared the winner of the Contest.
A Submitter may submit several videos, provided that each submission concerns a different person.
Important Note: Winners are randomly selected through a draw conducted among the participating Nominees for whom a Submitter has submitted a video, and not based on the selection criteria of the Nominees. To be eligible for the draw, the submitted content must comply with the described criteria.
A participant’s chances of winning depend on the number of videos validly submitted for the contest conferring a valid entry in a given region in accordance herewith.
To claim their prize, winners must correctly answer a basic arithmetic question applying the order of operations (e.g.: (10 x 3) – 5 = 25).
The Contest begins on December 5th, 2024, at noon Eastern Time. The closing date for entries and the end of the Contest is December 20th, 2024, at noon Eastern Time
PRIZES AND DRAW
Prize Description
A total of five (5) sets of winter tires [insert specific brand, size and other information that may accurately describe the product offered], courtesy of Pirelli Canada, will be awarded. Each set has an approximate value of $1,000, for a total value of $5,000. A set of tires will be awarded for each of the following regions:
West: British Columbia and Alberta.
Prairies: Saskatchewan and Manitoba.
Central: Ontario.
East: Quebec.
Atlantic: New Brunswick, Nova Scotia, Prince Edward Island, Newfoundland, and Labrador.
Draw Process
A random draw will be held for each region from among the eligible entries at the Organizer’s head office on December 24, 2024, at 1:00 p.m. eastern time. Winners will be contacted by e-mail, telephone or text message.
To be declared a winner, a person must:
answer the arithmetic question correctly; and
be reached orally by telephone by the Contest Organizer within, three (3) days of random selection; and
sign the declaration and waiver of liability form (hereinafter the “Declaration Form”) that will be sent to him/her and return it by e-mail to the Contest Organizer no later than three (3) days following its receipt
Failure to comply with any of the conditions mentioned in these rules will result in the selected entrant’s entry being cancelled and a new draw for this prize will be held in accordance with these rules until an entrant is selected and declared a winner.
Within four (4) to six (6) weeks following receipt of the duly completed and signed Declaration Form, the Contest Organizer will inform all winners of the manner in which they may take possession of their prize.
LIMITATION OF LIABILITY
Entrants release the Organizer and Pirelli Canada, to the fullest extent permitted by law, from any liability in connection with the malfunction of any computer component, software, or communication line, in connection with any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network, and which may limit the possibility or prevent any person from participating in the Contest. Participants also release the Organizer and Pirelli Canada from all liability for any damage or loss that may be caused, of any nature whatsoever, directly or indirectly, in whole or in part, by the downloading of any Internet page, software or form and by the transmission of any information related to participation in the Contest.
All prizes must be accepted as described in these rules and cannot be transferred to another person, substituted for another prize or exchanged in whole or in part for cash, subject to the provisions of the paragraph dealing with prize substitution.
No price guarantee
The value of the prizes is for information purposes only. Entries and rights in a prize are non-transferable.
Prizes are provided “as is” without warranty of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or conformity.
No returns or exchanges of prizes will be accepted.
Environmental fees may apply when tires are disposed of.
In the event that, for reasons unrelated to a winner, the Contest Organizer or Pirelli Canada is unable to award a prize (or a portion of a prize) as described in these rules, it reserves the right to award a prize (or a portion of a prize) of the same nature and equivalent value or, at its sole discretion, to award the value of the prize (or portion of the prize) indicated in these rules in cash.
Organizer and Pirelli Canada’s liability
The Organizer and its affiliates, employees or agents, and Pirelli Canada cannot be held liable for any loss, injury or damage of any kind arising from participation in the Contest or use of the prizes.
The refusal of a person selected at random to accept a prize under the terms of these rules releases the Contest Organizer and Pirelli Canada from any obligation related to this prize towards this person.
TRANSFER OF RIGHTS
By participating in the Contest, Submitters and Nominees transfer to the Organizer, without remuneration and as sole consideration for participating, all economic and moral rights to the copyright and image of the submitted videos, stories, or content for any commercial, promotional, or advertising use, on all media, without time or territorial limits. The Submitter undertakes to obtain the Nominee’s consent to the use of her personal information, name, image and story, failing which the Submitter shall be solely responsible for any complaint filed by the Nominee, if any.
USE OF PERSONAL INFORMATION
Personal information collected during the Contest may be used by the Organizer for commercial, promotional, or advertising purposes. This information may be stored, shared with third parties, and made public until a request for removal is submitted by an individual with a legal interest in doing so.
Submitters or Nominees wishing to withdraw consent must notify the Organizer in accordance with the Privacy Policy available here: https://www.grtouchette.com/privacy-policy/.
Withdrawing consent before the draw will automatically void the participant’s entry in the Contest.
GENERAL CONDITIONS
The Contest Organizer reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this Contest in whole or in part in the event of any event, error or human intervention that may corrupt or affect the administration, security, impartiality or conduct of the Contest as provided in these Contest Rules. In all cases, the Organizer and its affiliates, related companies, divisions and subsidiaries, advertising and promotional agencies, suppliers of products or services related to this Contest, as well as their employees, agents and representatives, and Pirelli Canada may not be required to award more prizes than those indicated in these rules or award prizes other than in accordance with these rules.
Any attempt to use a system based on artificial intelligence to participate in the Contest is strictly prohibited and will result in immediate disqualification.
The Organizer reserves the right to disqualify any person or to cancel one or more entries from any person participating in this Contest or attempting to participate by a means contrary to the rules or likely to be unfair to other participants (e.g. computer hacking, use of computer robots to participate, use of artificial intelligence, , etc.). The Organizer further reserves the right to disqualify any person or to cancel one or more entries from any person participating in this Contest if it is deemed by the Organizer that the video submitted refers to a person who does not exist or with respect to whom a story is false or misleading. This person may be referred to the appropriate legal authorities.
Should the Submitter or Nominee fail to obtain all necessary authorizations and rights with respect to the content submitted, or be able to transfer them, the Submitter and Nominee are solely responsible, and the Organizer reserves the right to disqualify any person or cancel one or more entries by any person participating in the Contest.
The Organizer’s decisions are final and binding.
With respect to each entry, this Contest is governed by the laws of the province in which the entrant is located and the applicable federal laws of Canada. The Contest is also governed by the laws of the province of Quebec.
Any attempt to damage computer systems related to the Contest constitutes a violation of civil and criminal laws, and the Organizer reserves the right to claim damages.
